Privacy Policy
Introduction
This privacy notice summarises the key points about how Damar Limited (“Damar”) collects, uses and discloses personal data. This policy also explains how we use any personal data we may collect when you visit our website. Personal data includes your name, address, telephone number, email address and another information relating to you. This notice also explains how to contact us if you have any queries about how we use your personal data.
What is personal data?
Personal data is information which relates to an individual and from which he or she can be identified either directly or indirectly through other data which the controller of the data has or is likely to have in its possession. These individuals are sometimes referred to as “data subjects”.
Marketing
Occasionally we may contact our current or recent customers (students/apprentices and employers) with information we think may be of interest such as marketing information, details of events and competitions and industry news. If you prefer not to receive promotional or marketing material from us, please email us at (unsubscribe@damartraining.com).
If you are not a current or recent customer then we will not contact you for marketing purposes without your express consent.
We will never sell your information to third parties or share it outside our group for marketing purposes.
Damar looks at anonymised data across our business to understand and improve performance. This may include, for example, information on success rates subdivided by age, gender or region.
Sharing your information
In order to deliver our services, Damar may need to share certain information about you which can include with:
- the Education and Skills Funding Agency (ESFA)
- Ofsted
- Awarding bodies for the qualifications that we deliver
- End-point assessment organisations
- Our e-learning technology partners
These organisations will also usually become controllers of your data and will therefore have their own privacy notices.
Storing your information
Your information will be stored either electronically or in paper-based form.
We retain personal information for the period required by the ESFA or other funding partners. This is usually for a minimum of six years (unless otherwise requested by them).
Information derived from contracts with our customers and other information about you is stored electronically either locally at our head office or securely at a data centre based in the European Economic Area (“EEA”). Those data centres may use IT support based outside of the EEA and, as a consequence, data transfers outside the EEA are possible. Where data is transferred for support purposes it is protected by the EU approved model clauses.
Safeguarding
If we are concerned about the welfare of a student then we are under a duty to consider what, if any, action should be taken. Depending on the circumstances, action that we take can includes us sharing information with appropriate external agencies such as the police, local authorities or under the ‘Prevent’ initiative, which is part of the UK Government’s anti-terrorism strategy.
Internally, the sensitive personal information that may be disclosed in relation to student welfare issues is only ever shared with our safeguarding lead and deputies.
Individual Rights
You have a right of access to personal data that Damar may hold about you.
Personal data must be processed in line with individuals’ rights, including the right to:
- request a copy of their personal data;
- request that their inaccurate personal data is corrected;
- request that their personal data is deleted and destroyed when causing damage or distress; and
- opt out of receiving electronic communications from Damar.
If you would like to see the data that we hold about you, let us know and we will share it with you for no charge and to the extent allowed by law. If there are errors in the data, let us know and we will rectify it. We will also erase or restrict your data if requested but this may mean that we need to discontinue your apprenticeship.
If you are unhappy with how we use your data, wish to withdraw your consent or wish to rectify, erase or restrict your data.
