What exactly is an apprenticeship agreement? 

An apprenticeship agreement is a legally binding contract of service between you (the employer) and the apprentice. It sets out the terms and conditions of the apprenticeship, confirming the employment arrangements and expectations on both sides. 

It is one of two documents that all apprentices must sign before starting their programme. The other required document is the apprenticeship training plan, which is an agreement between the employer, apprentice, and your training provider

If your apprentice is under 18, then they will need to get a parent or guardian to sign on their behalf. 

Why is the apprenticeship agreement important? 

For an employer, the apprenticeship agreement is a critical – and legally required – document that underpins the entire apprenticeship programme. 

Both parties must sign it before the apprenticeship begins, ensuring that everyone is clear about their rights and responsibilities from day one. Without this document, your programme is technically non-compliant and can lead to severe consequences such as: 

  • Loss of funding: You could risk losing government funding 
  • Termination of programme: The apprentice may need to be removed from the apprenticeship
  • Legal disputes: A lack of a formal, signed agreement can lead to disputes and legal complications.

What should it include? 

The agreement will contain details about employment arrangements, working conditions and the apprenticeship programme itself. You and the apprentice will both receive a copy of the agreement to keep and refer back to should you need to. In more detail, it should contain: 

  • The apprenticeship’s job title and description
  • The start and end dates of the apprenticeship 
  • Working hours and wage details
  • Their holiday entitlement

  • An outline of the training to be provided
  • Notice periods and disciplinary procedures 
  • Working conditions. 

What are an apprentice’s employment rights? 

It’s crucial to understand that an apprentice is, first and foremost, an employee of your business, and apprentices have the same employment rights as other employees, such as: 

  • Holiday entitlement
  • Sick pay
  • Parental leave
  • Protection from discrimination 
  • Working hours and rest breaks 
  • Wages and pay (the apprenticeship minimum wage is lower than the national minimum wage to reflect the time and resource investment made by the employer). 

Your apprentice is also entitled to paid time for training. All of the off-the-job training hours, as set out in the apprentice’s training plan, must be completed during their normal, paid working hours.
